These Terms apply to purchases from and use of pawcuria.com. The website is operated by Clayton Wason, trading as Pawcuria Pets ("Pawcuria Pets", "we", "us" or "our").

Nothing in these Terms limits rights that cannot lawfully be limited or excluded.

1. Products

We take reasonable care to describe and display products accurately. Photographs are illustrative and colours can vary between screens, lighting and manufacturing batches. Measurements are approximate unless stated otherwise.

You are responsible for checking dimensions, sizing, compatibility and intended use before ordering.

2. Pet safety

Follow the product description, warnings and instructions supplied with each product. Supervise pets where appropriate, especially with toys, collars, harnesses, feeding accessories, electrical or rechargeable items and products containing small parts. Stop using any item that becomes damaged or unsafe.

Website content is not a substitute for veterinary advice.

3. Placing an order

Submitting an order is an offer to buy the products shown at checkout. An automatic order acknowledgement confirms receipt of the order but does not necessarily mean that we have accepted it. Unless we tell you otherwise, acceptance occurs when we confirm dispatch or otherwise expressly accept the order.

4. When we may decline or cancel an order

We may decline or cancel an order where reasonably necessary, including where a product is unavailable, there is an obvious pricing or listing error, payment is declined, we reasonably suspect fraud or unlawful activity, we cannot deliver to the address supplied, or fulfilling the order would breach applicable law.

If we cancel after taking payment, we will refund amounts paid for products we do not supply.

5. Prices and payment

Prices are shown in the currency displayed on the website and include applicable taxes where required. Delivery charges and other charges payable to us are disclosed before purchase.

Payment must be made using a method offered at checkout and may be processed by third-party payment providers.

6. Delivery

Our Shipping Policy forms part of these Terms. Products may be fulfilled by third parties and may arrive in separate parcels, but Pawcuria Pets remains responsible to you for our obligations as retailer.

7. Cancellations, returns and refunds

Our Return and Refund Policy forms part of these Terms. It explains applicable cancellation rights, returns, refunds and rights relating to faulty or misdescribed goods.

8. Warranties and statutory rights

Any manufacturer's or supplier's warranty is additional to your statutory rights and does not replace them.

9. Promotions

Promotions may have stated eligibility conditions, validity periods and exclusions. Promotional codes cannot be exchanged for cash unless we state otherwise. We may reject fraudulent or abusive use of a promotion.

10. Reviews and user content

If you submit a review, photograph or other content, it must be truthful, lawful and must not infringe another person's rights. Reviews should reflect a genuine experience with the relevant product or service.

We do not require fake reviews and will not knowingly present incentivised reviews in a way that conceals the incentive. We may moderate or remove content where reasonably necessary to comply with law or protect users.

11. Intellectual property

Unless stated otherwise, original Pawcuria Pets website content, branding and design are owned by or licensed to the legal operator and may be protected by intellectual-property law.

12. Third-party services and links

The website may use third-party services or contain links to third-party websites. Those services may have their own terms and privacy notices. We are not responsible for websites we do not control.

13. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights.

If you are a consumer, we are responsible for loss that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable when the contract was made.

15. Governing law and consumer protections

These Terms and contracts made through pawcuria.com are governed by the laws of England and Wales.

If you are a consumer, you retain any mandatory consumer protections that apply because of where you live. Nothing in this clause prevents you from bringing proceedings in a court that applicable consumer law entitles you to use.
